An Act Relative to Patient Safety.

Summary:

Establishes and regulates the membership and operation of a nursing advisory board within the executive office of health and human services; directs the board of registration in nursing to establish an expert nursing corps, known as the Clara Barton expert nursing corps; authorizes the articulated state institutions of higher education to enter into employment contracts with faculty members who teach nursing; directs the board of higher education to implement the articulated programs to improve nursing education and assist nursing students in the commonwealth; establishes and regulates the use of the Clara Barton Nursing Excellence Trust Fund; directs the department of public health to develop nurse patient assignment standards; directs said department to establish and implement a standardized patient acuity system, which compares the registered nurse staffing level in each nursing department or unit against actual patient nursing care requirements; regulates the assignment of nurses to patients; prohibits assigning non-licensed personnel to perform licensed nurse functions; articulates penalties for failures by medical facilities to adhere to said requirements; directs the department of public health to issue regulations to promulgate said provisions.
