Summary:

Prohibits imposing liability on physicians or nurses administering immunizations or other medical protections under public health programs, in any civil suit for damages resulting from any act or omission; prohibits imposing liability on physicians or nurses for any act or omission elated to voluntary participation in any disaster preparedness or response activities.

Title:

An Act Relative to Patient Safety.

Summary:

Establishes and regulates the membership and operation of a nursing advisory board within the executive office of health and human services; directs the board of registration in nursing to establish an expert nursing corps, known as the Clara Barton expert nursing corps; authorizes the articulated state institutions of higher education to enter into employment contracts with faculty members who teach nursing; directs the board of higher education to implement the articulated programs to improve nursing education and assist nursing students in the commonwealth; establishes and regulates the use of the Clara Barton Nursing Excellence Trust Fund; directs the department of public health to develop nurse patient assignment standards; directs said department to establish and implement a standardized patient acuity system, which compares the registered nurse staffing level in each nursing department or unit against actual patient nursing care requirements; regulates the assignment of nurses to patients; prohibits assigning non-licensed personnel to perform licensed nurse functions; articulates penalties for failures by medical facilities to adhere to said requirements; directs the department of public health to issue regulations to promulgate said provisions.

Amends various provisions relative to the assumption of burial expenses by the department of welfare or the department of transitional assistance for the indigent, elderly and beneficiaries of aid to families with dependent children; repeals provisions mandating a suitable marker for the graves of said deceased and an opening of said graves; repeals provisions articulating the services provided by the funeral director in said cases; repeals provisions authorizing a maximum expense of 1,500 dollars for a funeral and burial.
