Access Requirements for Pedestrian Ramps and Road Resurfacing

A key question arose during a Disability Access Coalition Meeting in the summer of 2008 about the access requirements which are triggered by road resurfacing under the law. The City WAS NOT making ramps accessible during resurfacing projects. The answer to the question is that when a road is resurfaced it is required by the ADA and Section 504 of the Rehabilitation Act that curb cuts be ADA and AAB compliant. The City of Boston agreed to comply with these requirements for all road resurfacing beginning in March 2009. This is now City policy.
During the last several weeks, I went to many sites in the City of Boston to assess the improvement of access requirements for pedestrian ramps and road resurfacing. The following documentation will show that this policy needs more enforcement and contractors need more education and training about access requirements.
